Terms and Conditions of the Promotional Campaign “Welcome Bonus for Pyszne.pl Couriers”

§ 1. Organiser and General Provisions

1. The organiser of the promotional campaign “Welcome Bonus for Pyszne.pl Couriers” (the “Campaign”) is Eter Jobs sp. z o.o. with its registered office in Warsaw, address: Al. Niepodległości 18, 02-653 Warsaw, entered in the register of entrepreneurs of the National Court Register (KRS) under number 0001156235, NIP (tax ID): 5214106738 (“Eternis” or the “Company”).
2. The Campaign is addressed to Couriers who commence cooperation with Pyszne.pl through Eternis, on the terms set out in these Terms and Conditions.
3. The Campaign runs from 1 August 2026 to 30 September 2026. Eternis may end the Campaign earlier, with due respect for the acquired rights of Participants (§ 6(2)).
4. The Campaign is not a game of chance, a lottery or mutual betting within the meaning of the Polish Gambling Act of 19 November 2009.

§ 2. Definitions

1. Courier — a natural person delivering orders within the Pyszne.pl platform.
2. Participant — a Courier who, on the date of joining the Campaign, cooperates with Pyszne.pl under the existing model (directly, without the involvement of Eternis) and who, during the Campaign period, commences cooperation with Pyszne.pl through Eternis.
3. Bonus — a one-off cash benefit of PLN 250 gross, granted to a Participant on the terms set out in § 4.
4. Agreement — a contract of mandate (umowa zlecenia) concluded between a Participant and Eternis, under which the Participant performs deliveries for Pyszne.pl.

§ 3. Conditions of Participation

1. The Campaign is open to a person who jointly meets all of the following conditions:
1. holds the status of an active Pyszne.pl Courier under the existing cooperation model, as positively verified by Eternis,
2. provides, when concluding the Agreement, the same telephone number as the one assigned to their courier account with Pyszne.pl,
3. concludes an Agreement with Eternis during the Campaign period,
4. meets the standard requirements for commencing cooperation with Eternis (including being of legal age, holding the right of residence in the Republic of Poland, the right to work/provide services in the Republic of Poland, and having the required documents and medical examinations),
5. has not cooperated with Eternis during the 3 months preceding joining the Campaign,
6. at least one settlement between the Participant and Eternis under the Agreement takes place during the Campaign period.
2. Participation in the Campaign is voluntary. A person joins the Campaign upon concluding the Agreement, which constitutes acceptance of these Terms and Conditions.
3. Each Participant may receive the Bonus only once, regardless of the number of Agreements concluded or accounts held in partner applications.

§ 4. Welcome Bonus

1. A Participant who meets all the conditions of participation set out in § 3 is entitled to a Bonus of PLN 250.00 (in words: two hundred and fifty Polish zloty) gross.
2. The Bonus will be paid out together with the first settlement referred to in § 3(1)(f). The Bonus is paid by adding its value to the Participant’s balance in their account in the Eternis application.
3. The Bonus constitutes the Participant’s income and is subject to taxation and social security contributions in accordance with the form of the Participant’s cooperation with Eternis and applicable law.
4. The Bonus cannot be combined with other promotions, welcome bonuses or referral programmes organised by Eternis, unless the terms of a given promotion expressly provide otherwise.
5. The Bonus is not due if, before the condition referred to in paragraph 1 is met, the Agreement is terminated or the Participant breaches its material provisions (in particular the rules of performing deliveries or of fair cooperation).

§ 5. Thermal Bag

1. A Participant transferring from Pyszne.pl uses their existing thermal bag.
2. If the Participant’s thermal bag is destroyed or damaged to an extent preventing the proper performance of deliveries, Eternis will provide the Participant with a new thermal bag free of charge. The assessment of the bag’s condition rests with Eternis and is carried out during a meeting at the Eternis office.

§ 6. Amendments to the Terms and Conditions and Termination of the Campaign

1. Eternis may amend these Terms and Conditions for important reasons, in particular in the event of changes in the law or in the rules of cooperation with Pyszne.pl, or in order to prevent abuse. Amendments take effect upon publication of the amended Terms and Conditions at https://pyszne.eternis.pl/.
2. Neither an amendment to the Terms and Conditions nor early termination of the Campaign deprives a Participant of the right to the Bonus if, before such amendment or termination, the Participant met the conditions for obtaining it.
3. In the event of a justified suspicion of abuse (in particular providing false information, creating multiple accounts or feigning the status of a Pyszne.pl Courier), Eternis may withhold payment of the Bonus until the matter is clarified and, if the abuse is confirmed, refuse to pay it.

§ 7. Complaints

1. Complaints regarding the Campaign may be submitted by e-mail to: biuro@eternis.pl, within 14 days of the event giving rise to the complaint.
2. A complaint should include the complainant’s first and last name, contact details and a description of the matter. Eternis considers complaints within 14 days of their receipt and informs the complainant of the outcome by e-mail.

§ 8. Personal Data

1. The controller of Participants’ personal data is the Company.
2. The Company has appointed a Data Protection Officer, who can be contacted at: rodo@eternis.pl.
3. The Participant’s personal data will be processed for the purpose of:
1. the Participant’s joining this Campaign, i.e. taking advantage of the opportunity to obtain the Bonus provided for in these Terms and Conditions. The legal basis for the processing of personal data is the conclusion of the Agreement between the Participant and the Company on the terms provided for in these Terms and Conditions (Article 6(1)(b) GDPR). For this purpose, the data will be processed for the period necessary to perform the Agreement,
2. establishing and pursuing possible claims. The legal basis for the processing is the Company’s legitimate interest, i.e. the ability to pursue claims and defend against claims (Article 6(1)(f) GDPR). For this purpose, the data will be processed for the period of pursuing claims or defending against claims.
4. The Participant provides their personal data voluntarily; however, failure to provide it will make participation in the Campaign, as well as the granting and settlement of the Bonus, impossible.
5. Via the e-mail address rodo@eternis.pl, the Participant may exercise their rights of access to and rectification of their data and of data portability, and may request the erasure or restriction of processing of their data or object to their processing. The Participant also has the right to lodge a complaint with the supervisory authority (the President of the Personal Data Protection Office, PUODO) regarding the protection of their personal data.

§ 9. Final Provisions

1. Matters not regulated in these Terms and Conditions are governed by Polish law, in particular the Civil Code.
2. These Terms and Conditions are available at https://pyszne.eternis.pl/ and at Eternis offices.
3. These Terms and Conditions enter into force on 20 July 2026.
